Rove implicated in Siegelman prosecution

Time has a story out that implicates Karl Rove and Gov. Bob Riley's staff in the prosecution of Don Siegelman.

The allegation was made by Dana Jill Simpson, a lifelong Republican and lawyer who practices in Alabama. She made the charges in a May 21 affidavit, obtained by TIME, in which she describes a conference call on November 18, 2002, which involved a group of senior aides to Bob Riley, who had just narrowly defeated Siegelman in a bitterly contested election for governor. Though Republican Riley, a former Congressman, initially found himself behind by several thousand votes, he had pulled ahead at the last minute when disputed ballots were tallied in his favor. After the abrupt vote turnaround, Siegelman sought a recount. The Simpson affidavit says the conference call focused on how the Riley campaign could get Siegelman to withdraw his challenge.

According to Simpson's statement, William Canary, a senior G.O.P. political operative and Riley adviser who was on the conference call, said "not to worry about Don Siegelman" because "'his girls' would take care of" the governor. Canary then made clear that "his girls" was a reference to his wife, Leura Canary, the U.S. attorney for the Middle District of Alabama, and Alice Martin, the U.S. attorney for the Northern District of Alabama.

Canary reassured others on the conference call — who also included Riley's son, Rob, and Terry Butts, another Riley lawyer and former justice of the Alabama supreme court — that he had the help of a powerful pal in Washington. Canary said "not to worry — that he had already gotten it worked out with Karl and Karl had spoken with the Department of Justice and the Department of Justice was already pursuing Don Siegelman," the Simpson affidavit says. Both U.S. attorney offices subsequently indicted Siegelman on a variety of charges, although Leura Canary recused herself from dealing with the case in May 2002. A federal judge dismissed the Northern District case before it could be tried, but Siegelman was convicted in the Middle District on bribery and conspiracy charges last June.

I have been wondering about this (4.00 / 1)
ever since I saw that statistic that 87% of the state and local officials indicted by the Bush Dept. of Justice were Democrats and only 12% were Republicans.  This in spite of the fact that only about 57% or so of all those elected officials are Democrats.  Does anyone know what those percentages are in Alabama?  Or how to find out what they are?

that will probably be linked to Rove is Beth Chapman's zeal in exposing vote fraud in West Alabama.

Ms. Chapman, you may recall, offered monetary rewards to anyone who exposed vote fraud in black-majority counties and said she would personally observe the voting there last November.

I don't guess we can expect to see her watching the polls in Shelby or Baldwin counties any time soon.

Do you have a link?  More people need to know about stuff like this.

Kind of related: I just heard that the county license office doesn't always give people a voter registration form when they check the box on their drivers license form.  People think they registered to vote because they checked the box, but they aren't because the clerk didn't give them the form and tell them to fill it out.  There is lots of voter discouragement going on in Alabama and we really need to fix at least some of it before the 2008 election.

MONTGOMERY, Ala. (AP) — Two of three Republicans who reportedly took part in a 2002 telephone conference call to plot against former Gov. Don Siegelman said Friday the phone call never took place and the third called reports of the conversation an "outrageous allegation."

The New York Times and Time magazine reported earlier Friday that they had obtained an affidavit from an Alabama attorney, Dana Jill Simpson of Rainville, who said she was on a conference call in late 2002 with Republican operative Bill Canary when he made a comment indicating GOP-appointed federal prosecutors would make sure Siegelman was no factor in the 2006 governor's race.

And here is an interesting tidbit:

Canary is currently the president of the Business Council of Alabama and is married to Leura Canary, U.S. Attorney for the middle district of Alabama.

And in 1994, the Business Council of Alabama hired Karl Rove to help elect Republican, business friendly judges in Alabama according to this article in The Atlantic.  There is a Repub good old boy network, headed by Rove and the Canary's are part of it.  If I recall correctly, the other people involved in that phone call with Simpson were Bill Canary, his son and Riley's campaign manager. 

All that changed in 1994. Rove brought to Alabama a formula, honed in Texas, for winning judicial races. It involved demonizing Democrats as pawns of the plaintiffs' bar and stoking populist resentment with tales of outrageous verdicts. At Rove's behest, Hooper and his fellow Republican candidates focused relentlessly on a single case involving an Alabama doctor from the richest part of the state who had sued BMW after discovering that, prior to delivery, his new car had been damaged by acid rain and repainted, diminishing its value. After a trial revealed this practice to be widespread, a jury slapped the automaker with $4 million in punitive damages. "It was the poster-child case of outrageous verdicts," says Bill Smith, a political consultant who got his start working for Rove on these and other Alabama races. "Karl figured out the vocabulary on the BMW case and others like it that point out not just liberal behavior but outrageous decisions that make you mad as hell."

The people with Simpson for the phone call were Bob Riley, his son and and Terry Butts.  Butts (as of last year, he was one of Scrushy's attorneys) went so far as to say he had never heard of Simpson.
